Use useMockly Responsibly
The rules, commitments, and limitations that apply when you use useMockly’s interview practice and AI-assisted features.
1. Acceptance of Terms
- These Terms of Service ("Terms") govern your access to and use of Mockly's websites, applications, and services (the "Services").
- By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility & Accounts
- You must be at least 16 and able to form a binding contract to use the Services.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- Notify us immediately of any unauthorized use or security breach.
3. Services & AI Outputs
- Mockly provides AI-assisted interview practice, feedback, and related tools. Outputs may be probabilistic or imperfect and are provided for guidance only.
- You are responsible for verifying outputs before relying on them. We do not guarantee accuracy, completeness, or suitability for any purpose.
4. User Content
- You retain ownership of resumes, job descriptions, interview recordings/transcripts, and other content you submit ("User Content").
- You grant Mockly a limited, worldwide, non-exclusive license to host, process, and use User Content to provide and improve the Services.
- You represent that you have all necessary rights to submit User Content and that it does not infringe or violate others’ rights or laws.
5. Payments & Credits
- Certain features require time credits or paid plans. Prices, taxes, and billing terms are shown at checkout.
- All purchases are subject to the refund and billing policies presented at the time of purchase. Failed or disputed payments may result in suspension.
6. Acceptable Use
- You will not misuse the Services, including: reverse engineering; interfering with security; misrepresenting identity; scraping without permission; or uploading unlawful, harmful, or infringing content.
- You will not use the Services to create or disseminate malicious code, harassment, discrimination, or other prohibited content.
7. Intellectual Property
- Mockly and its licensors own all rights, title, and interest in the Services, including software, branding, and content (excluding User Content).
- You may not copy, modify, or create derivative works of the Services except as permitted in these Terms.
8. Third-Party Services
- The Services may rely on or link to third-party services (e.g., payment processors, analytics, AI model providers). Your use of those services may be governed by their terms and policies.
9. Disclaimers
- The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant uninterrupted, secure, or error-free operation, nor accuracy or reliability of outputs.
10. Limitation of Liability
- To the fullest extent permitted by law, Mockly and its affiliates will not be liable for any indirect, incidental, consequential, special, or exemplary damages, or loss of profits, data, or goodwill, arising out of or in connection with the Services.
- Our aggregate liability arising from or relating to the Services will not exceed the amounts you paid to Mockly in the 6 months preceding the claim.
11. Indemnity
- You agree to defend, indemnify, and hold harmless Mockly and its affiliates from claims, damages, liabilities, and expenses arising from your use of the Services or your breach of these Terms.
12. Termination
- We may suspend or terminate access if you violate these Terms or if required by law or operational needs.
- Upon termination, your right to use the Services ceases; certain provisions (e.g., IP, disclaimers, limitations) survive termination.
13. Changes to Terms
- We may update these Terms to reflect changes in the Services or legal requirements. Material changes will be communicated through the Services or email where appropriate.
- Your continued use after changes become effective constitutes acceptance of the updated Terms.
14. Governing Law
- These Terms are governed by the laws of the applicable jurisdiction stated in your order or account region, without regard to conflict of laws principles.
- Any disputes will be resolved in the competent courts of that jurisdiction, unless otherwise required by applicable law.
